Under the terms of §1 of art. 41 of Law no. 13.709/18 (General Data Protection Law), all communications, queries and complaints regarding the data that Balera handles in its capacity as Controller must be addressed to the e-mail lgpd@balera.com.br.
It brings together guidelines that guide the behavior of Partners, Lawyers and Collaborators in their relations with each other, as well as in their environment.
It ensures that the partners, lawyers and employees of Balera, Berbel e Mitne Sociedade de Advogados observe and act in accordance with the requirements of Brazilian law, in particular, but not limited to, those of Law No. 12.846/13 ("Anti-Corruption Law") and its Regulatory Decree (Decree No. 8.420/15), as well as those of the Foreign Corrupt Practices Act ("FCPA") and the United Kingdom Bribery Act ("UKBA"). It also establishes specific rules aimed at inhibiting acts of undue advantage between private entities.
Clarifies the commitment of Balera Sociedade de Advogados ("Firm") to ensure the protection of personal data of Clients and Third Parties who may have their personal data processed by the Firm under the terms of item X of article 5 of Law No. 13.709/18 ("General Data Protection Law" or "LGPD"). All terminology used hereafter will follow the conceptualizations contained in the LGPD. From a perspective of protecting the fundamental rights of freedom, privacy and the free development of personality, which guide the actions of Balera Sociedade de Advogados, the aim of is to offer a clear explanation of why, when and how the processing of personal data of Clients and Third Parties takes place, as well as an explanation of their legal rights based on the provisions of the LGPD.
Its purpose is to ensure that the Partners, Lawyers and Collaborators of Balera, Berbel e Mitne Sociedade de Advogados observe and act in accordance with the requirements of Brazilian legislation, in particular, but not limited to, those of Law No. 13.709/18 ("General Data Protection Law - LGPD"). It also establishes specific rules aimed at regulating.
The Ethics Committee is Balera, Berbel e Mitne Sociedade de Advogados' highest body for investigating complaints of non-compliance with the Code of Ethics, Internal Policies, Anti-Corruption Legislation and Brazilian laws.
